Purpose
Your agreement with Learning Dev Academy (LDA) is governed by this policy, as well as the Learning Dev Academy (LDA) Terms & Conditions and the Learning Dev Academy (LDA) Privacy Policy.
This policy details the conditions under which Learning Dev Academy (LDA) will reimburse you for a Course Fee that you have already paid.
At any moment, we reserve the right to review, revise, or update this policy. If we decide to make changes to this policy, we will let you know and make the new policy available to you.
General
Learning Dev Academy (LDA) offers a variety of services, including short courses, facilitated workshops, webinars to help you learn new things and advance in your chosen field.
Binding agreement
Your enrollment in a Course offered by Learning Dev Academy (LDA) is subject to the following Terms and Conditions, which combined with the Learning Dev Academy (LDA) Refund Policy and the Learning Dev Academy (LDA) Privacy Policy constitute the agreement between you and Learning Dev Academy (LDA).
Course fee
You agree to pay the Course Fee using the method indicated on the enrollment form, which may exclude GST. You further agree that the entire Course Fee is due regardless of whether or not the Course is completed.
If you are under 18:
Course enrolment, commencement and duration
Payment in the agreed upon amount constitutes full enrollment in the course. The length of time you’ll be required to devote to the Course is detailed on the course website, in the initial email, and/or when you sign up (Course Completion Date).
If you are unable to finish the Course before the Course Completion Date, you can request more time by following the steps outlined below. Learning Dev Academy (LDA) will withdraw your enrollment if you do not request extension.
Course materials
Unless otherwise specified in the Course description, all course materials are provided either electronically or in physical form.
You should check with Learning Dev Academy (LDA) ahead of enrollment to see if the programme you’re interested in has downloadable Course Materials. No other use of downloading Course content is permitted.
Learning Dev Academy (LDA) serves as a portal to any online course materials that may be made available to you. At the time of enrollment for self-paced courses, or at least 5 days before the start of class, students will get their login information. Although the Learning Dev Academy (LDA) LMS platform is usually accessible around-the-clock, seven days a week, there are times when it will be down for maintenance. In the event that you are unable to access the Learning Dev Academy (LDA) LMS, Learning Dev Academy (LDA) will make alternate arrangements for the distribution of your Course Materials.
Course extension
All requests for additional time in a course must be submitted in writing no later than 7 days before the original course end date. A one-time extension of three months is available for self-paced courses upon request. Assignments submitted post the course end date will be marked as late.
Course transfer
Within the first seven days of your Course Start Date, you may switch to another Learning Dev Academy (LDA) Course at no additional cost. This is contingent upon the following:
Payments
You can pay the Course Fee using the Learning Dev Academy (LDA) payment portal.
You must obtain the approval of the cardholder to use their credit or debit card to pay the Course Fee if it is not issued in your name.
At the time your payment is authorised, the Fee (less any rebates or credits applied) will be charged to your credit card and a receipt will be made available for you to print.
After a payment has been made, it cannot be retracted under any circumstances. Even if you pay the Course Fee, it doesn’t mean you’ll automatically learn everything there is to learn.
Learning Dev Academy (LDA) cannot be held responsible for any fees your credit card company may charge you.
Direct debit
To officially sign up for a Course, you need to fill out an Enrolment Form and pay either a deposit or the full Course Fee. We do not release certificates until the whole Course Fee has been paid, even if you enrol using our flexible payment plan that allows you to pay in instalments by direct debit. Learning Dev Academy (LDA) may charge you a dishonour fee in addition to any other fees incurred as a result of a payment being declined under a direct debit payment plan owing to insufficient funds.
If full payment is not received, Learning Dev Academy (LDA) has the right to cancel your enrollment and refuse to provide your Certificate/Statement of Attainment.
Refunds
Unless otherwise agreed with Learning Dev Academy (LDA), you will receive 90% of tuition fee refunded if the Course is terminated up to 7 days from the Course Commencement date.

Learning Dev Academy (LDA) responsibilities
Learning Dev Academy (LDA) owes it to you to give you a Course that helps you become competent as much as possible. We, Learning Dev Academy (LDA), promise to supply the following.
Your responsibilities
You, the undersigned, are a student at Learning Dev Academy (LDA), and as such, agree to the following:
Intellectual property
Learning Dev Academy (LDA) is the owner of all intellectual property contained within the Course Materials, logos, and other material found on the website. Without Learning Dev Academy (LDA)’s express written permission, you may not make copies of, duplicate, edit, or adapt the Course Materials or any other materials provided to you by Learning Dev Academy (LDA) in any way.
Communication
You are required to provide Learning Dev Academy (LDA) with a valid email address that you routinely check. All notices and other information pertaining to the Course, the Learning Dev Academy (LDA) website, and other pertinent information will be communicated to you via the email address provided, and you consent to receiving such notices and information via email. If your email address ever changes, you must let Learning Dev Academy (LDA) know right away.
Termination
There is a 6-month window for both the Self-Paced and Foundation courses.
If you violate any of these Terms and Conditions in Learning Dev Academy (LDA)’s reasonable judgement, we may terminate your access to the Course materials; however, if the violation can be corrected and Learning Dev Academy (LDA) is notified of the violation within 7 days, we will not terminate your access to the Course materials.
Limitation of Liability and Disclaimers
Learning Dev Academy (LDA) makes no assertion, representation, or warranty that a Course or Course Materials are fit for your requirements or are mistake free. The Courses and Course Materials are designed solely to supplement your education in Australia; they are not meant to take the place of your own independent study, the completion of your own independent study assignments, or your own independent work.
Information, names, images, photos, logos, and symbols regarding or pertaining to Learning Dev Academy (LDA), its goods and services (or to third party products and services) are given “as is” and “as available” by Learning Dev Academy (LDA) and any third party that may provide such content.

You and Learning Dev Academy (LDA) both consent to the non-exclusive jurisdiction of the courts located in Victoria.
In the event that any provision of these Terms and Conditions is found to be illegal, invalid, or unenforceable under the laws of any state or country in which they are intended to be effective, then such provision shall be null and void to the extent and within such jurisdiction and the remainder of these Terms and Conditions shall survive and remain binding and enforceable.
No part of your rights under these Terms and Conditions may be assigned to anyone else. In some circumstances, Learning Dev Academy (LDA) may assign our rights under these Terms and Conditions to a third party.
Revision
Learning Dev Academy (LDA) has the right to adjust these Terms and Conditions at any moment by publishing a new version on the website. To be apprised of any changes we may have made to our Terms & Conditions, please check back here regularly.
Promotions
Learning Dev Academy (LDA) may, at any time and without prior notice, modify the terms of a promotion or the period of time during which a certain voucher code is valid.
Learning Dev Academy (LDA) retains the right to withhold or revoke a coupon, discount, or promotion if the conditions are not met within the indicated expiration period.
Promotional period payments made using a discount code or voucher are non-refundable and may only be transferred to eligible course credits or alternatives with the express agreement of Learning Dev Academy (LDA)’s administration.

Student Work
You agree that we may use your portfolio work, project work, client work, personal work, interviews, images, individual work, group work, and more (collectively referred to as “Student Work”) to promote Learning Dev Academy (LDA) and its services.
You agree that Learning Dev Academy (LDA) can use your name and any visual or verbal excerpts from your Student Work for any purpose, including but not limited to promotion and advertising, in any medium.
Your Student Work may be included on Learning Dev Academy (LDA)’s website, landing pages, course materials, social media platforms, and electronic direct marketing (eDM) messages, among other possible uses.
Learning Dev Academy (LDA) will credit you on your project, portfolio, or other work. You agree to provide Learning Dev Academy (LDA) with a perpetual, worldwide, nonexclusive, royalty-free licence to use, copy, modify, publish, upload, distribute, transmit, publicly display, and create derivative works from your Student Work for any purpose, including advertising and marketing for Learning Dev Academy (LDA) and its services.
Furthermore, you agree that your Student Work is neither secret or proprietary.
User Content
You and other Users of Learning Dev Academy (LDA) may have the option of using various chat rooms, forums, and message boards to interact with one another.
In addition, Learning Dev Academy (LDA) may allow you and other Users to upload, post, and make available visual or verbal content from your portfolio, articles you have authored, personal project work you have generated on Learning Dev Academy (LDA)’s platforms, channels, and touchpoints (collectively, “User Content”).
(a)You warrant that you have and will continue to have the necessary rights to use, copy, modify, distribute, publicly perform, publicly display, and distribute all User Content you make accessible or ask us to publish through any of Learning Dev Academy (LDA)’s platforms, channels, and touchpoints.
(b) posting your User Content on Learning Dev Academy (LDA)’s platforms, channels, and touchpoints will not cause a breach of contract between you and a third party;
(c) posting your User Content will not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights, or any other rights of any person or organisation. Your use of Learning Dev Academy (LDA)’s channels, platforms, and touchpoints to distribute User Content constitutes your agreement to pay any and all royalties, fees, and other payments owed to any individual.
You also acknowledge and agree that your User Content is non-confidential and non-proprietary.

As a company, we focus on serving the progressive and digital communities by organising and hosting events, lectures, and courses as well as sending out email material. How can you access your personal information?
Contact the Advisors Team if you would want access to any of your private information. Within a fair time frame, you may expect a reply from us. We won’t charge you an arm and a leg to provide you the details you need. Access to your private and sensitive information will be denied only in limited circumstances when doing so is authorised by law. If we do decide to deny access, we will explain why.
How can you update your personal or sensitive information?

How will we use your personal or sensitive information?
We will only use your private information for the original purpose it was gathered for, any secondary purpose to which you have consented, and any other purpose for which we have a legal basis to do so. We shall take reasonable precautions to verify the veracity, accuracy, timeliness, completeness, and non-misleading nature of your private information before utilising it.
When will we disclose your personal information to a third party?
If the disclosure is directly related to the purpose for which the information was collected, and we have no reason to believe that the you concerned would object to the disclosure, or if you have given your prior consent to the disclosure, we will only disclose your information to a third party under the conditions described in the privacy notice provided to you at the time of collection. We may give out your contact info to our event partners if we’ve established that we’re working together on anything. Also, if the workshop instructors have pledged to send you slides, we may provide them your contact information.
